Poclink "Don't Watch Alone" Campaign Terms & Conditions

Welcome to the Poclink "Don't Watch Alone" Campaign (the "Campaign"), hosted by Poclink Tech LLC ("we," "us," or "our"). By participating in this Campaign, subscribing to our channels, or uploading your content, you agree to be bound by these Terms.

1. Eligibility & Campaign Period

This Campaign is a limited-time event. Specific start and end dates are posted on the official campaign page. We reserve the right to adjust, suspend, or terminate the Campaign at our sole discretion.

2. How to Enter & Prize Pools

We offer two distinct entry tracks. You may participate in both:

The Voucher Pool (Social Engagement): You can enter this pool through two methods:

  • Email Subscription: Simply subscribe to our official email newsletter.
  • Social Media Channels: Follow our official accounts AND engage (like or comment) with our campaign posts on TikTok, Facebook, Instagram, or YouTube. Please note: To qualify, you must perform BOTH actions (Follow AND Engage) on any given platform. Merely following without engaging, or engaging without following, will strictly result in disqualification. The more platforms where you complete both requirements, the higher your chances of winning.

The Creator Pool (UGC Submission): Submit creative photos or videos of you using a Poclink device with family and friends—whether you’re roaring at home or live in a stadium. To officially enter this prize pool, you MUST complete all of the following steps:

  1. Follow the official Poclink account on the platform where you post.
  2. Publish your creative photo or video publicly on TikTok, Facebook, Instagram, or YouTube.
  3. Tag our official account @poclink in your description.
  4. Include both required hashtags: #poclink AND #watchwithpoclink.

Failure to complete any of these steps (such as missing a hashtag or posting on a private account) will result in disqualification.

Higher video performance or a higher volume of qualifying posts will significantly increase your chances of winning.

3. Intellectual Property Rights (IPR) & Content Usage

  • Your Ownership: You retain the copyright and ownership of any content (photos, videos, audio, text) you submit.
  • Our License: By posting content and enter this campaign, you grant Poclink a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable license to use, host, store, reproduce, modify, publish, distribute, publicly display, and create derivative works from your content across all marketing channels, including but not limited to social media, paid ads, website banners, and promotional materials.
  • No Infringement: You guarantee that your submission is your original work and does not infringe upon the intellectual property, trademark, or privacy rights of any third party. Crucial Note: Your content must not feature protected tournament logos, official sports federation trademarks, or restricted commercial branding without authorization.

4. Third-Party Permissions & Releases

  • People & Places: You declare that you have obtained explicit consent and releases from all identifiable individuals (including their names, voices, and likenesses) featured in your content.
  • Minors: If your content features anyone under the legal age of majority in their place of residence, you guarantee that you have obtained written permission from their parent or legal guardian for commercial usage.

5. Content Standards

Submissions must be clean, safe, and positive. We will instantly disqualify any content that contains:

  • Illegal, hateful, discriminatory, defamatory, or sexually explicit material.
  • Dangerous stunts, violence, or actions that risk personal safety or property damage.
  • Unauthorized commercial advertising or spam.

6. Prize Distribution & Taxes

  • Winners will be announced via our official app, social media channels, or notified via registered email.
  • If you win, you are solely responsible for any local income taxes, customs duties, or import fees required by your country of residence.
  • Prizes will be shipped globally, but we are not responsible for delivery failures caused by incorrect or incomplete shipping information provided by the user.

7. Limitation of Liability & Indemnification

  • Safety First: You acknowledge that any filming activity is done at your own risk. Poclink is not liable for any personal injury, property damage, or legal disputes arising from your recording or participation in this event.
  • Indemnity: You agree to defend, indemnify, and hold Poclink harmless from any third-party claims, losses, or legal expenses (including attorney fees) arising from a breach of your warranties or any copyright/privacy infringement claims related to your submission.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state of Nevada, United States, without regard to its conflict of law principles. Any legal action arising from this Campaign shall be settled in the competent courts of that jurisdiction.
